This means they are not your employees, and you are not required to provide benefits such as healthcare, insurance, or comply with labor laws related to employment. For freelancers or VAs based outside your country, let’s take the example of the Philippines or Serbia, you should have them fill out a W-8BEN form, which confirms they are foreign independent contractors. You keep this form for your records. There’s no 1099 form, withholding, or government reporting required for foreign contractors outside the U.S. However, if you hire a U.S. citizen or resident (and you as an employer are from the US), you may need to issue tax forms, such as a 1099, if payments exceed a certain threshold.
